    Abstract: This paper builds on the Ostroms' oeuvre to suggest that the binary Samuelsonian taxonomy of goods – or the ‘sterile dichotomy’, as Elinor Ostrom calls it – cannot serve as a reliable guide for public policy. Using the Ostroms' insights on co-production, institutional matching, and polycentricity, we argue that the ‘inherent’ nature of goods and their specific taxonomy are not static and definitive concepts but are instead contestable and dynamic features that are institutionally contingent. We explore four crucial mechanisms and/or contexts, not altogether unrelated, whereby the nature of goods becomes contestable and malleable: namely, (1) technological and geographical factors, (2) coproduction and entrepreneurial ingenuity, (3) bundling and unbundling of services, and (4) ideologies and regime shifts. This exercise has twofold purposes. First, we generalize the notion that there is nothing ‘inherent’ in the nature of goods and services and that they are fluid, heterogeneous, and malleable concepts. Second, we contribute to the debate on the provision of public goods and the role of civil society by highlighting the need for institutional malleability and diversity adaptive to changing technology, contexts, and institutional conditions.

    Abstract: Criminologists have long viewed morality as a critical element in offending. However, two factors limit the theoretical impact of prior work. First, no overarching framework for describing the nature and role of morality has been developed. Second, morality has been measured in a narrow manner as the extent to which individuals disapprove of particular acts of offending. To address these limitations, we examine the utility of a moral psychological framework—Moral Foundations Theory (MFT)—that fits remarkably well with the conceptions of morality found in criminological theorizing (i.e., that morality inhibits offending, has intuitive and pluralistic dimensions, and under certain circumstances may motivate offending). Methods: We use negative binomial regression to model self-reported counts of violence, group violence, theft, property damage, marijuana use, and illegal phone use while driving, in a large national sample of Icelandic youths (n = 10,710). Results: We find that individualizing moral intuitions centered on rights and autonomy and binding moral intuitions centered on social order and cohesion are uniquely associated with different types of offending and exhibit inhibiting or motivating effects depending on the outcome. Conclusion: MFT holds considerable promise as a framework for conducting criminological research on the relationship between morality and offending.

    Abstract: How does the presence of multiple combatants affect rebel groups’ ideological and demand positioning? Although violent forms of inter-group conflict have been widely studied in the civil war literature, rebel groups’ strategic use of ideology and demands has received scarce scholarly attention. We argue that the pressure of competition forces rebel groups to differentiate themselves ideologically and demand-wise from their rivals to maximize their chances of survival and success. Rebel groups strive to set themselves apart by offering unique products to their supporters and recruits. Thus, we contend that rebel groups are more likely to modify their ideologies and demands from the government in the face of competition from rival groups. We test this theory using novel data collected from rebel group manifestos and public statements. Our findings suggest that groups are more likely to shift their ideology and modify their demands as the number of rival groups increases.

    Abstract: Anthropocentric mode of consciousness has disturbed the internal cohesion and inter-relatedness of the natural world and is leading the world towards environmental devastation. Climate change is one of the biggest threats to humanity and is the face of this crisis. In view of this, the paper argues that we should make a shift towards ecocentric ways of thinking which look at nature in holistic terms and recognise the intrinsic value and rights of all the constituents of nature—rivers, mountains, plants and animals including human beings. Human existence is possible only when different constituents of nature interact with each other in a positive way. The paper argues that ecocentric awareness should be embedded in human governance system, law, education, culture and ethics, to save the world from environmental devastation.

    Abstract: New institutional economics (NIE) studies institutions and how they emerge, operate, and evolve. They also include organizational arrangements, intended as modes of governing economic transactions. Universities offer an exciting ground for testing the role of different institutional arrangements (governance forms) in coordinating (academic) transactions. In a context of contractual incompleteness where production is characterized by a highly specialized nature and requires the cooperation among co-essential figures, we argue that shared governance models ( versus models with more concentrated authority) foster idiosyncratic investments in human capital and promotes performance. From the evolutionary viewpoint, we explain why institutions based on shared governance have developed within universities. The normative question of how universities should be governed is a debated issue in the literature. Since the 1980s, the new public management paradigm provides a theoretical framework that suggests analyzing university like firms. It is based on the firm's archetypical conception as top-down hierarchical organizations and as a descending sequence of principal–agent problems. We advance a different interpretation of the university–firm analogy leveraging on the NIE and its developments. To empirically analyze our hypothesis, we collected original data from Italian universities in 2015. We find that more shared decision-making processes are correlated with better research performance.

    Abstract: In a fascinating recent debate in the pages of this journal, several legal philosophers have clashed over the very existence and nature of the deontic position of Hohfeldian no-rights. While the debate has many strands, and has become increasingly intricate, I want to focus on one—or, the—central strand, a strand the importance of which cannot sensibly be questioned. Countering Andrew Halpin, I shall vindicate the dual nature of the claim-right/no-right relation, recently articulated by Matthew Kramer. In so doing, I go far beyond anything Kramer has currently ventured. Ultimately, then, I am countering Heidi Hurd & Michael Moore by vindicating the existence of Hohfeldian liberties. The Hohfeldian table emerges unmarked.
