    Abstract: Points for practitioners The role of states, either through a shift in their regulatory influence or by means of direct economic intervention, has undergone changes in the last 15 years of European integration. The strengthening populism and illiberal turns may be rooted in the re-understanding of member states’ role in integration through the activism of radical governments and/or political powers, not only in politics. This article is about how the risks of this shift are mirrored in the sectoral policies of public services.

    Abstract: Les règles sur les services d’intérêt général autorisent des exceptions au droit du marché intérieur de l’Union européenne. Ces exceptions restent-elles vraiment dans les limites de la libre concurrence ? Aujourd’hui, cette question ne semble pas indépendante du risque de considérations politiques directes influençant le marché des services publics. Cette tendance peut se traduire par des mesures législatives ou administratives nationales susceptibles d’aller à l’encontre de l’esprit des objectifs initiaux de l’intégration de l’Union européenne. Le droit matériel et procédural de l’Union européenne ne semble pas soulever d’obstacles inévitables à ces démarches. Dans le contexte du cadre réglementaire de l’Union européenne pour les services d’intérêt général, notre recherche porte sur les résultats d’une analyse d’une base de données d’affaires judiciaires de l’Union européenne qui met en évidence les défis et les menaces des récents instruments nationaux d’organisation du secteur public pour le fonctionnement du marché intérieur de l’Union européenne et les règles de concurrence. Remarques à l’intention des praticiens Le rôle des États, que ce soit par l’évolution de leur influence réglementaire ou par des interventions économiques directes, a subi des changements au cours des 15 dernières années d’intégration européenne. Le renforcement du populisme et les virages vers l’intolérance trouvent peut-être leur origine dans la redéfinition du rôle des États membres dans l’intégration à travers l’activisme des gouvernements radicaux et/ou des pouvoirs politiques, pas seulement dans le monde politique. Cet article porte sur la manière dont les risques de cette évolution se retrouvent dans les politiques sectorielles des services publics.

    Abstract: The scope of derogation possibilities for Services of General Interests in the EU internal market has been widened by legislators for more than fifteen years. The process is also supported by the case law of the Court of Justice of the European Union. State aid and other influential instruments are allowed to derogate from internal market and competition rules while their roles are heavily discussed in the circumstances of free market economy. Are these solutions leading to new regimes in European integration? This study aims at reconstructing the sense of this process in its details. This analytical study is based on comparative legal investigations applying qualitative and quantitative methods.

    Abstract: Compatibility of economic advantages with the internal market refers to the economic impact of state aid that is permitted by EU competition rules. In general, this approach is based on the acceptance of derogations from basic obligations in a market economy, that may also be granted by the European Union to its Member States. Due advantages seem compatible with EU law per se, however, such compatibility also depends on the discretion of the competent administrative and judicial bodies. According to the analytical and empirical legal policy investigation presented in this article, the activity of the Court of Justice of the European Union is increasing in order to allow exceptions from general rules and extend the scope of compatibility in this field. This process may lead to enhance derogations from market-based commitments in Member States, typically in certain Central and Eastern European countries, which tend to emphasize the primacy of national regulation and are keen to exploit the potential of such broader regulatory autonomy. The aim of the study is to identify the origin and nature of this risk in order to support efforts that may diminish harmful effects in an EU-wide context. The empirical evidence of the paper derives from a systematically selected set of case law as a context by which the examined policy orientation is mirrored.

    Abstract: National interest, also as a critisism against the pradigm of New Public Management (NPM), is very much emphasised nowadays in public policies, even in sector ones. This article is about a removal from the classical meaning of general (public) interest to that new approach represented by certain EU Member States and the reasons behind. Our analysis focuses on contextual motives and impacts of these changes illustrated by the Hungarian case. The result shows that the market of public utility services has already been influenced by direct political considerations. Our findings indicate that these understandings for legitimate influence on EU market rules can also be derived from the legal framework itself. Measures examined in the paper run completely counter to the spirit of the original intention of the founders of the integration, and recent changes in EU law do not seem to raise unavoidable obstacles to such cases. Lessons of this case may be relevant for other EU Member States as well, at least for those from the Central-European region.
