Abstract: Introduction/Objective. Professional burnout has sparked academic interest as one of the phenomena with the most serious implications for healthcare employees? well-being. As burnout becomes an increasingly common issue in medical practice, more extensive research on its predictors is needed. This study aimed to examine whether and how job satisfaction and work-related burnout affect personal burnout. Methods. A structured questionnaire was used to collect primary data. The sample consists of 218 employees from transfusion medicine units located in five cities in the central part of Serbia. Descriptive statistical analysis, correlation, and hierarchical regression were applied. Results. We found the personal burnout is negatively affected by job satisfaction, predominantly by working conditions (? = -0,141, t = -2,780, p 〈 0.01), and positively impacted to work-related burnout (? = 0,690, t = 13,409, p 〈 0.001) indicated that workload has strong impact on personal life quality of healthcare professionals employed in blood banks. Conclusion. This research contributes to more comprehensive understanding of personal burnout factors. The findings of this study can be used to develop strategies to promote employee well-being and prevent burnout in different manifestations.

Abstract: Ensuring a workforce is up to date on the latest trends in a rapidly changing business environment is one of the main challenges facing modern companies. To achieve long-term profitability and encourage innovation, they tend to constantly improve employees’ knowledge and skills. This paper aims to identify the impact of learning orientation on company performance and to test the mediating role of innovativeness in this relationship. The empirical research was conducted on a sample of 79 companies in different industries in the Republic of Serbia. Descriptive statistical analysis, correlation, and regression analysis were applied to the data collected. The research results indicate that learning orientation significantly and positively affects performance and innovativeness in Serbian companies. In addition, the findings show that firm innovativeness partially mediates the relationship between learning orientation and performance, i.e., learning orientation leads to better company performance through increased innovation in all business aspects. The paper contributes to identifying practical implications for managers, pointing out the importance of creating a learning environment and employees´ innovative behaviour as a basis for achieving better business outcomes. Therefore, managers should take a proactive approach to their human resources, providing them with opportunities to acquire new knowledge and skills and develop innovative ideas.

Abstract: This paper purports to clarify the notion and the legal consequences of the subsequent difficulties in performance of a bilateral contract, which occur due to an unforeseeable change in circumstances under which the contract was concluded. A part of the paper deals with the conditions for invoking the change in circumstances pursuant to Serbian and comparative contract law. In addition, the paper attempts to distinguish subsequent difficulties in performance from the different types of impossibility, such as impossibility to fulfil the purpose of transaction, objective impossibility of performance, subjective impossibility of performance, practical impossibility, and economic impossibility. The difficulties in performance occur after conclusion of the contract and are assessed in relation to what the promisor knew, or was obliged to know at the time of conclusion. If a contract becomes excessively difficult to perform, but not impossible, the promisor would not be discharged on that account, but may be able to seek termination, or judicial adjustment of the contract. In contrast, the subsequent impossibility of performance may lead to contract termination, but cannot be the grounds for judicial adjustment of the contractual content. The subsequent difficulty in performance of a contract is not easily distinguished from the so-called practical impossibility. The performance is deemed to be practically impossible if it would be contrary to reason, good faith, or the principles of fair trade to require the debtor to perform as initially agreed.

Abstract: Sometimes parties to a contract agree on the wording of the contract, but disagree about its meaning. In such cases, the goal of purposive interpretation is to identify a legal meaning, within the limits of the language actually used, which best achieves the purpose of the contract in question. This paper presents the main features of Justice Aharon Barak’s theory of purposive interpretation of contracts, and examines his notions of subjective and objective purposes. Barak’s theory demands, at some point along the process of interpretation, that the judge determine the actual joint intent of the parties, as it was at the time of their entering into the contract, and in the situation where the parties themselves disagree over it. This requires a posterior inquiry into the true state of mind of other persons. The past intentions of others are regarded as historical-subjective psycho-biological facts. The author questions what goes on behind this subjective rhetoric, starting from the presumption that the inner reality of another person’s will, i.e. their past or present intentions, cannot be learned as a physical reality, but only as a socially constructed fact. Furthermore, the author examines the seemingly unwanted merging of Barak’s subjective purpose of contract with his objective purposes of contract at the lower levels of abstraction.

Palabras claves: estigma; discriminación; microsociología; marcos; Goffman.ABSTRACT: Despite its early presence in human societies, stigma was not addressed by social sciences until mid-twentieth century, with Erving Goffman’s definition of stigma as a profoundly discrediting attribute within a specific social interaction being one of the first attempts to produce a systematic and formal study of this phenomenon. Unlike many contemporary authors, Goffman accurately identifies features of social stigma that allow for its clear delimitation from other social phenomena related to its manifestations, understanding the acknowledgment of stigma’s conceptual singularity as a first step required for analysis and comprehension of its complex manifestations in different socio-cultural contexts. Goffman’s microsociology and, particularly, his concept of frames as schemata of interpretation that organize human experience, provide a fertile and, at the same time, relatively unexplored, theoretical ground for the analysis of social stigma, and the mechanisms involved both in its social construction and its impact in different areas of human interaction. From that perspective, frames constructed, among other social processes, through narratives and other forms of popular communication, facilitate the recognition and coding of objects, situations, experiences and sequences of actions based on the value system assumed by specific communities, being continually modified and adjusted through social interaction. Keywords: stigma; discrimination; microsociology; frames; Goffman.
